FAQs about Child Custody

What is the law on child custody?

The welfare, nurturing, and growth of a child are the main concerns of child custody law. Courts now refer to “lives with” and “spends time with” rather than “custody” when discussing living arrangements and time distribution between parents.

How can my child custody agreement be legally documented?

A Parenting Plan or a Consent Order are two ways to formally establish your child custody agreements. A Consent Order is a legally enforceable document that has been approved by the court, whereas a Parenting Plan is informal and not legally binding. With a consent order, you can be sure that your agreement is enforceable and that any infractions can be handled by the court.

What if I am unable to reach a custody agreement with my ex-partner?

Before requesting a court order, you must engage in mediation with a trained dispute resolution specialist if you are unable to come to an agreement. To prove mediation participation, a Section 60I certificate is needed. You can apply for a parenting order in court if mediation doesn’t work out.

What aspects do judges take into account while deciding child custody?

The kid’s safety, emotional and developmental needs, each parent’s capacity to provide for those needs, and the advantage of preserving ties with both parents, if safe, are all taken into account by the court when determining what is best for the child. Any history of abuse or neglect is also taken into consideration by the court.

Is it possible for me to have sole custody of my child?

If it is in the child’s best interests, sole custody may be requested. The court will assess the situation and decide whether the child should live primarily with one parent or if one parent should have sole parental responsibility. If it is determined that one parent is unable to provide a relationship for the child with the other parent, sole custody may be awarded.
